Formal activities related to legalization of residence and employment of a foreigner take place in a single administrative procedure. Along with the permit, the Voivode issues a residence card. The application for a permit is submitted by foreigners who intend to stay in Poland for more than three months, and the main purpose of their stay is to perform work. Such a permit cannot be obtained if a foreigner:
• is a posted employee of an employer, whose office is located outside of Poland;
• stays in the territory of the Republic of Poland on the basis of international agreements to facilitate the entry and temporary stay of certain categories of natural persons involved in trade or investments;
• conducts business in Poland;
• performs seasonal work;
• stays in the territory of the Republic of Poland on the basis of a visa issued by an authority of Poland or another Schengen country for the purpose of tourism or visiting family and friends.
In order to obtain a work permit, the amount of the foreigner’s remuneration may not be lower than the minimum remuneration, and may not be lower than the remuneration of employees performing work of a comparable type or in a comparable position. In addition, the employer, who is employing the foreigner should have a certificate from the starost responsible for the main place of performing work by the foreigner, confirms the inability to meet the employer’s HR needs with the workforce from the local labour market. The foreigner should also have health insurance (financed from public or private funds). A foreigner should submit an application for a permit with attachments to the voivode competent for the place of current residence. In the case of submitting documents via post, the authority will summon the applicant to appear in person as it is required to provide fingerprints. A foreigner may appeal against the decision to the Head of the Office for Foreigners within 14 days from the date of receipt of the decision.
