The “declaration procedure” is a simplified procedure under which a foreigner may be employed without the need to obtain a work permit. Citizens of the Republic of Armenia, the Republic of Belarus, the Republic of Georgia, the Republic of Moldova, the Russian Federation and Ukraine may work on the basis of the declaration. In order to take advantage of simplified procedure, a foreigner’s employer must obtain an entry in the application registry at the district employment center. A foreigner should have a document confirming the right of residence in the Republic of Poland, which entitles him/her to work on the territory of Poland. On the basis of the declaration, work can be performed for a maximum of 24 months. After this period, the employer may submit another declaration. In order to obtain the registration, the employer should submit a statement to the competent district employment office or via the website. The statement must be accompanied by proof of payment of a fee of PLN 30. As a rule, the entry takes place within 7 days of receiving the declaration (the exception is when the authority conducts explanatory proceedings). The authority refuses the entry by way of a decision. A negative decision may result, inter alia, from in a situation where it appears from the circumstances that the statement is made for the sake of appearances, the statement will be used by the foreigner for a purpose other than work, the entity does not fulfill the obligations related to running a business or entrusting work. The authority always refuses entry when the employer has a criminal record in connection with the assignment of work to foreigners. The decision may be appealed against to the minister responsible for labor matters.
